My younger brother  is serving as a Govt Employee in UP state govt and I am suspecting 498A. I want to know if he is also named in 498A, DV etc then will his be lost? If yes then is there any remedy I can take beforehand to avoid his job lost, my legal separation from him will help or any other suggestion.

DV ACT - NO HE WILL NOT LOOSE JOB UNLESS HE IS CONVICTED FOR VIOLATING A PROTECTION ORDER. IN CASE OF CONVICATION UNDER 498a HE WILL LOOSE THE JOB.

I think the question means the following:-

What will happen to the job of Govt employee if 498-A and DV is filed against him.

As long as he is not arrested and gets AB in 498-A, he would be safe.

If he is arrested and remains under Police Custody for more than 24 hours, he would be suspended. The said suspension can be revoked later, either after he is aquitted, or even before, if the reasonable explaination is provided.

However, conviction under any offence means that he would loose his job.

Join someone from your area for any assistance. The groups Save Indian Family and Rakshak and 498a.org are helping hapless victims of false complaints
