Building maintenance charge

Hi All,

Greetings.

We have recently purchased a flat in hyderabad from bank. The previous owner has disappeared for almost 2 years. The Maintenance due of the apartment is Rs.28000, keeping 50% of the actual charge for 2 years.

 

Do we need to pay the 28000 for which we never enjoyed any of the facilities till this date and there would have been no service to this closed flat for 2 years. Do we need to pay the amount for the repairing of the lift, motor in this 2 years? What is the legal stand in this?

Your liability starts from thew date of purchase only. In agreement there should be disclaimer of all such liabliilities and should specify that Seller assured and had paid all such dues and Municipality taxes , and all dues till the date of sale. Please see your sale deed and also ask the lawyer about this.
