Bombay Shops act

Dear All,

I need to know whether under this act SL needs to be encashed. Sice working hours prescribed is 48hrs, i need to know if it is a violation of the act when a co works for 51 - 54hrs a week. Kindly revert at the earliest.

There are rules regarding leaves under Bombay Shops and establishment Act. Casual Leave is generally granted 7-12 days in a year which may or may not encashable . It is for employer to decide as per service condition. Sick Leave is generally granted 12-15 days in a year which generally is not encashable but some employer do permit upto certain number of days. Accumulation can be upto 90-150 days as per service condition laid down by the employer. Privilege leave is granted at the rate of 21 days a year. Under Shops act accumulation is 42 days but employer may permit accumulation upto 180 to 240 days and can be encashed.

I would like to know the minimum PL that can be given under Bombay Shops and establishment ACT. Is it 1 day for every 15 days or 1 day for every 20 days. Thanks & Regards Anjali
