both parties claiming the seized cash to be theirs. de facto filed petition for the refund of the seized cash, police gave no objection, accused claimed the cash seized belongs to them. need relevant judgements in this regard for de facto

Then it's better to contest for the amount if the accused file declaration suit on that, till then the same has to be treated as only custodian or trustee of the amount.

Aside, police normally give no objection should not be deem as ownership of that amount by the defacto complainant.
