Bar council enrollment clarification

Dear sir / madam,

One of my friend completed his Law degree and enrolled with the Bar Council of Andhra Pradesh, Hyderabad in 2014 (i.e., before the bifurcation of Telangana).  He has been doing business since then.  Now, he wants to start practicing again. However, upon verification, his enrollment is not reflected in the Telangana Bar Council records, but it is shown in the Andhra Pradesh Bar Council records.  Please confirm whether he can continue to practice, file cases, and appear before courts in Telangana.  Basically he is from Telangana.

Yes he can continue to practice in Telangana state, if necessary he can get re-registered in Telangana if advised.

 After bifurcation, the Bar Council of Telangana was constituted separately, but advocates already enrolled with Andhra Pradesh remained validly enrolled there unless they opted for transfer. 

 Right to Practice Enrollment with any State Bar Council under the Advocates Act, 1961 allows practice throughout India, not just in that state. Since your friend’s name is still reflected in the Andhra Pradesh Bar Council records, his enrollment is valid. He can appear, file cases, and practice in Telangana courts without needing re-enrollment, because the right to practice is nationwide.

 Transfer Option If he wishes to have his enrollment reflected under the Telangana Bar Council, he can apply for a transfer of enrollment. This is optional, but often preferred by advocates who primarily practice in Telangana, as it helps with local Bar Association membership, welfare schemes, and voting rights in that council.

 Practical Steps Verify enrollment status with the Andhra Pradesh Bar Council (ensure his Certificate of Practice is up to date). If expired, he must renew his Certificate of Practice (COP). If he wants to shift, file a transfer application to the Telangana Bar Council. Meanwhile, he can start practicing immediately

Whether you or your friend (advocate enrolled) contacted Telangana Bar council after leaving his business and decided to join legal profession ? Why did he want to join legal profession after so much gap ? Did he inform the Andhra Pardesh Bar council (before bifurcation) regarding doing business and keep his licence suspended durig this period?

How did you/ your friend came to know that his name appeared in Andhra Pardesh Bar Council ?

Let your friend /you may contact concerned (Telangana / Andhra Pardesh) Bar Council for necessary action.

When did your friend qualify LLB?

If after 2009-10, was the enrollment provisional?
