Bank memo received with reason "cheque distroyed"

maine apne employee ko Bank account ke through loan diya us loan amount ko vapas karne ke liye mere employee ne mujhe post dated (filled and signed by him) aur consent letter speed post se mujhe bheja lekin 1st july 2019 ko jab maine 1st cheque bank me present kiya to mujhe bank se memo mila "cheque distroyed". please suggest karen ki mujhe kya karna hoga jisse mujhe apna sara loan ka paisa us employee se vapas mil sake. kya isme 138 ka case file hoga ya 420 IPC ki complaint file krni chahiye

Also ask your employee for a fresh cheque as it was stated as destroyed by the bank and enclose copy of the cheque.

Mera employee cheque reissue karne ke liye agree ni hai uska Kehna h ki usne khud net banking option ka use kr k cheq destroyed mention kiya h ab sirf settlement hi krne k liye bol rha h

Most unbelievable, as no collecting banker can destroy or take directions of the drawer. This amounts to fraud also on part of the banker in conspiracy with the employee. A difficult issue to be sorted out with a local advocate who can visit the banker and discuss the actual issue as such a reason cheque destoryed was never used by any bank for informing the payee.
