Attrocities on depressed and helpless person

Dear Sirs, I am writing on behalf of my brother who is suffering from depression however has been recovering since some time now but incidents like recent one his trauma comes back and he becomes more fearful. Incident has happened in the Ishanagar village where he is living as of now alone his father is gone, he is not married neither has a job but still trying to live, however there also people are there would used to drink alcohol and ganja and unnecessarily ask him to either drink or give money or stop his way, in return my brother abuses them like this few incidents have happened , but physical assault has started happening on the first day of new year of 2024 but we did not complaint it and thought that was heat of the moment, now some of them say that they belong to some party and can use guns to eradicate if we raise our voice, another incident recently happened when one of his younger brother who is driver of BJP MLA and assaulted my brother, every now and then specially one family men are doing this over and over again whenever he is alone, my another brother works private job and earns merely for daily needs and i am younger brother also trying to support family, my concern is this is our village also and why MP government is loose on hooliganism or such type of people. Please suggest i want to restore the confidence of my brother so that next time he meets someone face to face at least his head should not be down that he fought for his right to justice and defense, he is shivering in fear right now due to continuous incidents like these and even neightbors are like this and throws stone and sand on him and make fun of him and then if he retaliates then they try to get physical. Please suggest, Thanks

Prima facie it is a psychoogical problem in comparison to legal issue. It would be better to seek advise from some local psychologist.

If there is any human welfare orgnisation or any Human Rights agency in your village you can approach to them, You should write all this to your District magistrate and copies forwarded to You concerned SP and concerned MLA . Involve socail meadia too so that your case gets attention. Take care of your brother and help him recover .

Sure Sir, just a query that even if someone is depressed do physical assault to them or any type bad behviour is justified, because this imprints a long mental health impression in personality?

If he is harmed by external forces he has a right to seek legal remedies through police or court

Yes Sir, there are many people like Raymond and i genuinely think India needs to grow their thinking horizon and reove stigmas, however the more we go deep in society we tend to surprise ourselves with reality specially in rural areas.

From the facts stated, the matter involves repeated criminal intimidation, assault, harassment, and possible criminal conspiracy. Your brother's mental health condition makes the situation more serious, but every citizen is equally entitled to police protection irrespective of his health, employment, or social status.

The following legal steps may be taken:

  1. Immediately lodge an FIR at the jurisdictional police station for the offences disclosed, which may include:
    • Voluntarily causing hurt (Section 115/118 of the Bharatiya Nyaya Sanhita, 2023, depending on the nature of injuries),
    • Criminal intimidation,
    • Wrongful restraint,
    • Intentional insult provoking breach of peace,
    • Criminal trespass (if applicable),
    • Mischief (if stones or property damage is involved), and
    • Any other offence disclosed by the facts.
  2. If the police refuse to register the FIR, submit a written complaint to the Superintendent of Police under the applicable provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023. If no action is taken, file an application before the jurisdictional Judicial Magistrate seeking directions for registration of an FIR and investigation.
  3. Preserve evidence, including:
    • Medical records of any injuries,
    • Psychiatric treatment records (only to explain his vulnerability, not to undermine his credibility),
    • Photographs or videos,
    • CCTV footage, if available,
    • Audio recordings of threats,
    • Call recordings,
    • Names and contact details of witnesses.
  4. If there are threats involving firearms or political influence, mention these specifically in the complaint. Any claim that the accused are politically connected or can use weapons should be investigated by the police and should not deter you from pursuing legal remedies.
  5. Seek preventive action from the Executive Magistrate and police if there is a genuine apprehension of breach of peace. Preventive proceedings may be initiated against habitual troublemakers where warranted by law.
  6. Since your brother is suffering from depression and appears to be under severe psychological stress, continue his medical treatment and request the investigating officer to record his statement in a manner that accommodates his mental condition.

If there is credible evidence that the local police are deliberately shielding the accused because of political influence, you may submit a representation to the Superintendent of Police, the Inspector General of Police, or the Director General of Police, and, if necessary, approach the jurisdictional High Court seeking appropriate directions for a fair investigation.
