Arrests after fir in delhi?

Hello,

CAW cell proceedings are going in Nanakpura, New Delhi. Mediation is on Monday and IO told that if it gets failed, FIR/Case will be registered.

Want to understand what is the current scenario in Delhi.. Is there an Arrest automatically after FIR is registered or there is some notice given before the Arrest?

Appear in mediation on Monday and they will take two to three dates to mediate between the estranged spouses.  If mediation fails, the complaint is sent back to concerned police station and FIR is lodged and if the section are 498-A and 3 and 4 of DP Act, then being cognizable and non-bailable offences, the police can arrest the accused.  But, once the failure of conciliation in CAW cell and registration of FIR, you will be having enough time to move the appropriate court for "anticipatory bail".

@ Adv. Chandrasekhar. Just for general information. If an individual needs to apply for an Anticipatory bail : 1. Whats the procedure ? ( How and where to apply) 2. What will be approximate amount to be paid for seeking an Anticipatory Bail? 3. How long the Anticipatory Bail remain valid? 4. Does procedure for applying Anticipatory bail is same for different criminal offences in IPCs. 5. Does the procedure for applying fopr an Anticipatory Bail is same in Mumbai,Bengaluru, Kolkata, Chennai as it is in Delhi. Please Advice.

1.  It has to be filed before Additional Sessions Judge and if he does not grant AB, then one can go to High Court.

2.  Expenses depend upon the individual advocate.

3.  If AB will be granted without conditions, if will be applicable till regular bail is granted by the competent court.  If it is conditional, till the conditions are fulfilled.

4. Yes.  5.  Yes. (only in UP such AB provision is not there).
