Arbitration and jurisdiction in foreign purchase order

While placing a foreign purchase order, we keep Arbitration and Jurisdictional laws, in case of dispute.

My queries include

1. Which one should come first, arbitration or approach to court of law.

2. In case of conflicts, say arbitration is as per Indian / Singapore Laws but Courts be Eutopean/ USA, which one to prevail?

Regards,

Jayanta

you can keep both clauses while drafting agreement.
1.Always Arbitration clause came. if matter is not resolved in arbitration then you can go in court of law for justice.
2. jurisdiction clausei.e place of contract will be where contract or agreement is executed.
