Approving authority for leave combined with transit leave.

After release of an employee on transfer from one station (Old Station), certain transit period (15 days) is allowed for joining at New Station. Rule 6(2) of C.C.S (Joining Time ) Rules, 1979 state that joining time may be combined with vacation and /or regular Leave of any kind or duration except Casual Leave. Now, the queries are: 1. Since availing transit time doesnot require approval from any authority, whether regular leave combined with such transit period will require any approval. 2. If approval is required, authority at which station will approve.

As per rules and regulations, one has to get leave sanctioned with prior intimation to concerned authority, except exigencies like casual leave.  In some organisations the relieving period should also be intimated as employee may avail at any time either on his reporting or bringing the family. As you ought to combine the leave and releiving time , you should have obtained  such sanctiions before relieving, from the old station only.

Position is that transfer order of employee is issued at 9 PM,  and it states that that employee stands automatically relieved from old station with immediate effect.

There is prior intimation/information, whatsoever,  to employee. There is no gap between transfer order time  and relieving time.When leave is applied with old station, then reply is received  from old station that since employee is already relieved from old station, leave cannot be approved at old station. Old station suggested employee for applying leave at new station. Now, new station states that they can process leave only after joining of employee at new station. As such, leave, if any, approved by new station, after joining of employee at new station, shall be altogether is separate leave. Such leave is not combined with transit leave in any manner.

Your duty is to apply for such leave and let them transfer in between them and let controlling authority decide the issue.

As it is sanction of leave is the problem of higher authority and no one can question you any thing.

If your employer is a public authority, file RTI Application and seek information as a query following rules and regulatiosn as applicable to RTI.

It is not clear as to why you were at 9 pm and this issue is not single and may be having some serious background as the attitude of relieving an employee at 8 PM and asking him to report immediately etc., appears victimisation and harassment.  (Normally in case there is no exigency).

If the sanctioning authority does not/fails to entertain the application what will be the fate of that application and what will be the fate of the leave already taken by that employee?
