Applicability of section 21a of icai- council election

Section 21A of Icai application

During election campaign to Regional Cohncil, one candidate shared Google map of booth to electorate. Institute served SCM U/s 21A.

How to protect oneself?

Quick Summary
This discussion addresses a candidate receiving a Show Cause Notice (SCM) under Section 21A of the ICAI Council Election rules for sharing a Google Map of a polling booth. Advice suggests responding to the SCM by either denying the allegations or admitting and apologising for the act, ideally after consulting a legal professional. The general consensus is that sharing a map for voter guidance may not constitute misconduct, and a reply denying the allegations is recommended.

If you recieved the notice then it becomes your duty to issue a reply notice by either denying the allegations or admitting them and apologizing for the inadvertent act.

You consult an advocate in the local and move as suggested.

Prima facie, there is no misconduct as alleged. You may reply to the SCM denying the allegation after due legal consultation.

Reply the SCM explaining it is only for guidance of voters but not to lure or bribe them.
