Applicability of Muslim Law vs. Revenue Code in Inheritance Dispute (Uttar Pradesh)
In Village Aihar, Tehsil Dalmau, District Rae Bareli (Uttar Pradesh), there is a piece of land owned by a Muslim individual, and it is registered property. The owner has passed away, leaving behind his mother, wife, son, and daughter as legal heirs.
After his death, the wife transferred the entire property into her own name without giving any share to the mother. Now, the mother wants to claim her rightful share but is willing to initiate a case only if Muslim Personal Law (Mohammadan Law) applies. She does not want to waste her time, energy, and money if only the Uttar Pradesh Revenue Code, 2006 is applicable.
The question is: In such a situation, which law will govern the inheritance – the Uttar Pradesh Revenue Code, 2006 or Muslim Personal Law (Shariat)?
