Sir, The details of my divorce case: 1.the date of filing mcd petition 4.10.2013 2.25 lakhs paid prior to filing of mcd petition out of court 3.the date of last hearing 5.6.2015 wife filed withdrawal of mcd case dismissed. 4.case in 3rd additional family court in chennai. 5. What is appeal period and to which court 6.the date of dismissal 5.6.2015

Big mistake you have done that you havepaid her prior to filing, do you have proof . or have you stated in the petition that you paid her RS.25 lakhs and in lieu of that sheis ready togive consent for divorce, if so, only you can file appealin High court. what reasons she gave while withdrawing petition

It was indeed a big mistake that you paid the amount before filing the MCD. I just cant understand how the MCD took almost two years to get disposed. You can challenge the order in High Court and the limitation period is of 90 days. Take certified copy of the order from the court that is required to be enclosed with the appeal.
