Appeal -need input

My tenant without complining the conditional order to pay rental arrears, he went for an rent control appeal.

If appeal court asks 50% deposit to admit the appeal, whether my tenant can go without paying anything and can file appeal in high court?

Tenant is free to invoke the revisional/writ jurisdiction of the High Court. However, if the rent controller has ordered the payment of arrears, his eviction in inevitable unless he tenders the payment of arrears.
