ancestral property legal hires

Dear learned friends

Please clarify my doubt

Old person (X) Hindu of age 80 was died by left property 4 acres having wife,two sons and one grand daughter of age 17 years. now they want to sale this land.

My question is  who are the legal hires of this ancestral property to sign the document while registration

is it required to wait untill one grand daughter completes 18 years

Wife of the deceased old men and his sons are eligible for equal share but before that. you need to clarify whether the grand daughter is son's daughter or diceased daughter's daughter. If she is the son's daughter, then there is no need to wait for her signature. The only recital that" the property was sold for the family necessities and minor child benifits"  needs to be incorporated in the sale document. But if she is diceased daughter's daughter, then she is also eligiblle for equal share in the property. In that case, she being a minor, either you have to wait till she attains majority or else you need to obtain permission from the Court under Guardian and Wards Act to sell the share of the minor.

Dear sir,

Property is in  the name of grandmother and she is still alive .This property was given by here husband (grandfather) long time back say 25 years back  and he is no more. She has two sons , and she wants to transfer this property only to one son after she dies.  Will be second son can sue the first son.
