Ancestral property

1.I want a Settlement deed from my father for his Ancestral property in Kumbakonam. 2.It is presently occupied by my Father's elder brother, I would like to detach my share legally. 3. There are 3 shops and a house for rent in the disputed area and to this day I haven't received and share from the same in the form of Advance or rent. Can I appeal the court to vacate my father's brother from the premise and regulate the shop n house's rent?
