Amendment in affidavit u/s 138 nia ???

I have filled two cheque case against same accused.but in one case a typographic error in complaint and affidavit means copy paste done from second case. error is regarding the bank name where the cheqe was present.wrongly mention punjab and sind bank instead of state bank of india.now cross has been done.bank clerk recorded thr statement in favour of complaint as witness.is thr any judgment regarding similar facts.now magistrate is ready to allow amendment in complaint but not in affidavit..means ready to allow partly.need any favourable judgments similar to my facts.thanks

Amendments are allowed even in Appellate stage. But your case is different, there is typographical mistake in Affidavit also. There is provision for amendments to the petition but that provision is not available to the affidavits. But you are asking Judgment for amendment of affidavit. The admission cannot resile as per supreme court order. unless we work in the workshop we cannot guide you in this situation.
