Amednment of company's name

DEAR SIRS

WE HAVE FILED A RECOVERY SUITE AGAINST A PRIVATE LTD. CO. IN TIS HAZARI COURT. OUR FIRM WAS REGISTERED WITH REGISTRAR OF FIRMS IN MAY 1994. EITHER BY OUR OR SUB REGISTRAR'S MISTAKE, THE NAME WAS MENTIONED IN THE REGISTRATION AS AVS INDUSTRIES INSTEAD OF AVS SILVERPLATE. IF, WE GET THE AMENDMENT FROM REGISTRAR'S OFFICE NOW, PLEASE LET US KNOW WHETHER THE AMENDMEND BE EFFECTIVE FROM THE DATE OF REGISTRATION OR THE CURRENT DATE BEFORE COURT OF LAW. CAN YOU PLEASE ADVISE ME OF ANY RUILING BY ANY HIGH OR SUPREME COURT. ALSO, PLEASE SUGGEST US A COMETANT LAYWER ON THIS MATTER. LOOKING FORWARD TO YOUR EARLY REPLY. THANKS & BEST

It seems that the Registrar has wrongly recorded the name of your company in its records. You should go for rectification of master data in the records of ROC. The rectified name would be effcetive from the date of registration as this is the case of rectification of records of ROC and not change of name of the Company. I hope that your Certificate of Incorporation bears correct name of your company.

If the Certificate of Registration bears the wrong name, then check as to what name was made available to you while seeking name availability at the time of forming the comany and if correct name was made available and still Certificate of Incorporation was issue in the wrong name the ROC need to be consulted as whether you should go for rectification of recirds of ROC or change of name.

this is case of firm and not a company. still the advice given above wou;d be a good part of it. you can go for rectification of th name of your firm. if the partnership deed you had deposited with the registrar bears the name you wish to have .. it shall be duly rectified with retrospective effect.
