Agreement after filed money suit

Learned Friends, मेरे एक रिस्तेदार (प्रतिवादी) ने मुझसे verbal एग्रीमेंट के तहत कुछ राशि उधार लिया है, जिसे मैंने अपने बैंक खाता से प्रतिवादी के बैंक खाता में हस्तांतरित किया था। उक्त राशि प्रतिवादी मुझे लौटकर नहीं देने के कारण मैंने दिसम्बर 2019 को Order XXXVII के तहत Money Recovery Suit दाखिल किया, जो अभी एडमिशन हेतु लम्बित है, जिसकी जनकारी प्रतिवादी को नहीं है। इसी बीच प्रतिवादी ने मुझे August 2020 को एक एग्रीमेंट बनाकर दिया कि उक्त राशि मुझे अगले 3 महीनों के अंदर वापस कर देगा। 1. क्या उक्त एग्रीमेंट कानूनन बैधय है? 2. क्या उक्त एग्रीमेंट को मैं उक्त Suit में साक्ष्य के रूप में जमा कर सकता हूँ? कृपया मार्गदर्शन देने की कृपा करें।

The agreement to repay loan amount is admission of defendant which can be used in evidence, if required. However, no evidence is required in a suit under order XXXVII CPC, which you / your lawyer must be aware.

Your lawyer, who has instituted the suit under order XXXVII CPC is the best person to advise.
