Dear querist,

As per your querry you are not eligible for divorce by mutually within 1 year.So,better wait for completion of one year and file MCD u/s 13B of HMA.

You freind has to talk with your husband regarding all settlement issues and sign a MOU for MCD and agree for mutual divorce without any force or fraud and submit to jurisdiction where marriage has held,once first motion completed you have to wait for another 6 months for second motion,during this phase which is termed as cooling period is left for the parties to re think of their marriage

Once 6 months completed, the both parties has to be present for second motion.Hence,the megisterate will ask both spouse are they agree for divorce or not if said yes then decree is passed.

Let the marriage complete one year then file MCD petition u/s13B after 6 months divorce will be completed
