About appearence of accused in receiving summons before 3 da

My Client who is a female received a summon from magistrate court as she added as accused No.4 in a criminal case before 3 days of first hearing date.her husband received the summons on behalf of his wife and she not able to attend the court as she cannot make arrangements suddenly to travel as the court is nearly 400 kms .Can we file 317 petition through an advocate and whether there is any provision that lenient time should be given for first appearence as the summons received only before 3 days before the date of hearing.what is the provision as per law?
