If the Memorandum is acknowledgment of oral partition, already taken place, then it does not require registration. Because, under the deed, no new right is transfered or confered on any party and it only acknowledges existing rights.

Oral family settlement is permissible. AIR 1976 Supreme Court 807

Memorandum of family partition does not require compulsory registration AIR 1988 Supreme Court 881

Oral family settlement is acted upon then registration is not necessary but if by this unregistered memorandum partition is going to take effect then it requires registration right??
