By sale deed or relinquishment deed

"A house was partitioned between two brothers. They are now deceased. The property now stands in the names of two persons related to each other"

Is this posting a query riddle?

How the two brothers have the title to the property?

Did they not get the record for each of their property to date?

T. Kalaiselvan, Advocate (Advocate)     29 November 2023

If the brothers have partitioned the property by a registered partition deed, then that is sufficient to prove that the property was properly partitioned between them.

Now the shareholders can mutate the revenue records to their names on the basis of the said registered partition deed.

If one of the legal heirs of the deceased shareholders want to combine the two properties to one, then the legal heirs of the other deceased shareholder can transfer their share of property by executing a registered gift deed or sale deed.

The house is stated to have been partitioned by 2 borthers (since both deceased), how it can be inherited by 2 differently related persons ?

Vague facts.

It didnot stand in the name of deceased, if deceased died intestate his  mother, wife, childrens are heirs.
