Section 80 CPC is only a notice and  not filling suit. As such if the notice is not repiied, time to go to the court. No court can pass ex parte order on the basis of Notice under section 80 CPC.

Agree with Adv. NK Assumi still the matter is not in the court. Two months After notice has been delivered or left to the office of Govt. Or any public officer, the suit may be instituted.

It is only a notice before proceeding against some govt institutions

How will notice become a case without filing one?,   exparte decree is the one which is for the case not represented by the defendant/respondent when called for after having served with summons properly.
