498_final stage (Professional)     14 July 2016

498a witness stage opposite party not appearing

I am fighting 498a in Ghaziabad. It has been going on from last 3 years. The case is at evidence stage where PW1 (Mother) gave her chief and disappeared despite sending many summons through court. 

Even NBW were issued against here once which they recalled. So its their delay tactics which is going on. What could be my strategy to fight case under this scenario? 

Is there any section of crpc like 203 (applicable in complaint case only as my lawyer said) which is applicable to close the evidence and quash the case? 

Kindly advice.

If the cross does not take place the evidence is not complete.

 

it goes to the credit of accused if prosecution evidence is not there.
