498a-charge sheet

Wife filed 498a against me and my parent and my sister on April 2013. All of us got bail on june 2013. I.O. did not come to my home for investigation. He ask me to came to police station during investigation. There he demands a motorcycle rather then asking me any question. I refused.  Since then we are waiting for the charge sheet. I have a strong believe my wife feed my advocate. My questions are,-

1. When the charge sheet will be given?

2. How do I come to know if the charge sheet is given?

3. How do I get the copy of charge sheet?

4. Should I file RCR now?

5. Should I file RTI after receiviing charge sheet?

Please post your valuable comments.

After arresting the accused, there are several incidents and facts in it. After completing the entire investigation, police officer prepares a report and submits it to the Magistrate. This completed report is called as police report/charge sheet. The police report is nothing but a complaint made by a private citizen to the Magistrate. Submission of charge sheet means that the preliminary  investigation and preparation of the case is over and the next stage of it is the magistrate to take cognizance of the offence. It takes time nowadays atleast 2 years. You can see the case status online police portals. Magistrate will send you summons as soon as charge sheet filed.

1. Charge will be framed by the court after completion of the investigation by the police officer and on his report. A copy of charge sheet will be issued to you all.

2.The court will summon you.

3.A copy of charge sheet will be issued to you all at free of cost.

4.What do you mean by RCR?

5. No need to file any application under RTI. You will be prosecuted automatically.

Should I apply for RCR (Restitution of Conjugal Rights, which is also called Section 9 of Hindu Marriage Act) ?

if you all are bailed then don't give value more to police if they demands, say them to deposit chargesheet whenever they wish. you say that i am not worried what you say. speak them politely and never argue. keep mind cool and face smiling.

my challan is submitted on 03/02/14, all family members name removed by police. i was bailed by rajasthan high court. say police to remove names of your all family if they agree.

don't apply RTI to police here on this stage
