498a - appeal in msj


I had filed a 498A,406 and 3&4 of Dowry prohibition act in 2004 at the XIII Metropolitan Magistrate ( Mahila Court) . Trial of which has be culminated now in Feb 2010 and has acquitted A1. I wish to go for a higher appeal at the MSJ.

My queries:

1. what is the time period that im allowed to file an appeal in the MSJ?

2. What is the role of the APP of the XIII ACMM in filing the appeal? Can she influence the appeal?

3. What would the procedure be, if i have to surpass the APP of the said court?

4. In case i overshoot the appeal period due to delays from the APP and PS, what should my next course of action be to file the appeal?

Request you to please advise me at the earliest.

P.S: The judegement of XIII ACMM was given on Feb 01 2010.

If the trial court has acquited your husband, you stand very little chance of over turning it.

In fact, if you appeal further, he can easily prove your malicious intentions.

 

Best approach is go for a mutual seperation now. Since you have already lost the case, you are a target for cases now, for implicating him in false cases.
