Hi Experts,

One complaint under section 406,498a,325,506, r/w 120B has been filed in Court ( Instead to file complaint to Police direct). Now matter is under evidence for complaint side and no intimation is made out to accused till date.

Now this complainant contacted me in this matter as new case for me.

Is it possible to withdraw the present complaint from court and to file police complaint for instant action and recovery under same sections? Pl guide me.

Once complaint is submitted into the court, the court only having power to dismiss the case. No one can withdrawn in criminal cases.

If it was under a private complaint, the court has to decide about the disposal and not that without a notice/summon you can interfere with it so soon.
