In a case u/s 138 of N.I. Act, the COMPLAINT filed an attested affidavit IN EXAMINATION IN CHIEF , which are without signature of deponent. WHETHER EXAMINATION OF CHIEF IS ADMISEBLE OR NOT However the I ALSO identified the signature and the oath commissioner attestted the affidavit.  After cross examination, the complainant found the above said facts. NEXT DATE IS FOR FURTHER PROSECUTION EVIDENCE.

You can raise an objection regarding the admissibility of the chief examination and that the oath commissioner had not followed the court procedure and hence it is not admissible and again bring back to day 1 the entire procedure and drag the case.
