WE HAVE ISSUED STOP PAYMENT FOR THE CHQ... AFTER THAT IT WAS DEPOSITED TO BANK. THE SAME CHQ WAS GIVEN AS SECUIRTY.....NOW CHQ GOT BOUNCED AT RECVD LEGAL NOTICE UNDER 138 ACT....
HOW CAN PROCEED FURTHER. I HV THE TIME TO REPLY 15 DAYS....

immediately deny the legal liability through your lawyer.
Remember, stop payment & security hereinafter are no defences.

in 138 NI act you first maintain sufficient funds on that period. and you show that stop payment purpose. then give reply for reason.

Refuse to accept the liability in your reply to the notice. Stop Payment does not ward off the liability for cheque bounce.

The cheque law is short and simple so is defense.
First the complainant has to prove the liability and it should be legal. on this defense alone case can be dismissed.
