i have a two fold view point on this issue: 1. why are judges opposing or avoiding the present issue, if they are so immaculate? 2. tranparency differentiates democracy from dictatorship.

judiciary shouldnot be accountable, because it can act independently. indian legal system is much better than any other judicial, judges are accountable to the judiciery only.

let the judiciary act in transparent manner.....fewer times High Court judges would act like Kings with no accountability towards anyone. its a larger issue and must be discussed in forum.

Judiciary is an independent body and its independency means, full and true soverginity of our nation. It will be only be in dictatorship that judicary will be an accountable. To be 'fair and just' judicary must be independant and not accoutable....(from Adv. J.J.Bisukarma, Advocate, Bombay, High Court.)

In a democratic country like India every institution which serve as a piller to its very foundation should be limited by checks and balances otherwise a kind of anarchy will arise. Judiary however in the upper level of its heirarchy is doing very well but nobody except the suffering litigents in the lower judiciary knows the darker side of that bright visual.

Just by passing orders the duties of the courts are not ending. The judiciary is also to monitor the execution proceedings so as to confirm the object and the very purpose of passing the order is obtained.

Definitely. The discretion vested in the Judges ought to be exercised as per law laid down by the Supreme Court as well as the Legislated laws. It is not an unbridled power. In fact the various stages of appeals/Revision and subordination of Courts is because , the Legislature knew that no one is infallible. The mistakes made by Lower court are open to question in the Higher Judiciary. My contention is that Judiciary should be accountable but not to the Legislature and Executive , but to Judiciary itself. Settled precedents should govern as greater minds have applied their intelligence to the subject in question

Accountability means responsible or expected to give an explanation. Responsible to whom? To the Law and legal system. Explantion to whom the higherups. This two are parrellel but must be compromised at some point of time. That depends on the system, situation he handles. How ever Indian legal system is much better than any other for the judicial accountability to the Law, Justice, State and PEOPLE.

Yes the Judges are answerable for justice they provide in each case. Though the judgment is their opinion, they are accountable to their Higher Athority. If required, they have to produce or submit their report,
