After RCR filed by husband wife return with police protection before 1 st court hearing and stay her marital home. She did false complain to police that husband torture her mentally and physically. After police investigate it is clear that all complain are false as no FIR lodge to the police station. She also deny conjugal relation. Only stay at home but no relation with husband except money and her day to day requirement. She can left home again without any valid reason as she is mentally retarded and suffer psychological disorders. Have 1 daughter 7 years old.
(1) As FIR not registered to police station, only police investigate after her oral complain. How can we prove her mental cruelty ???
(2) Do we need to continue RCR petition at this situation as no other valid ground for Divorce petition.
