Validity of registered sale agreement in registrar office

We have registered a sale agreement in Sub Register office to buy a piece of site/land and duration we have mentions is "end of 90 Days" now we have found some issue with the scheduled property  due to the schedule property does not exist according to governament surveyor, which mentioned on the mother deed document. and Now we have orally requested the Property Developer/agent to call of the deal and reply the advances and expences and other cost/expenses incurred for the property. this issue we came to know only now and the sale of agreement is going to expire in 3 days. The excat cluase in sale agreement is "the parties herein covent to to complete the sale transaction and to execute the Absolute sale deed by the end of 90 days from the date of agreement, and time shall be the essense of the contract"

Now what will be the legal obligations we have to claim our advance money and other cost/expenses incurred towards the property from the Owner....
