Tenure of a managing committee

Namaskar,

Greetings to you and wish u a very happy navratri,
I request you to kindly address my following queries.
  1. We know that the maximum tenure of a CHS committee is 5 years but is this period of 5 years the maximum?
  2. Can a society reduce this period of the committee by following certain legal procedures?
  3. If yes then what should be the procedure, meaning should we pass a resolution to this effect, write a letter addressed to the Chairman/Secretary with signatures of majority of the members etc? If so then I presume that such thing will be only done in a SGBM?
  4. We already have passed a the book of the new Bye Laws and got it stamped etc after submitting a copy to the registrar, thus, does this mean that we have to stick to this tenure of 5 years as stated in this book or we still can reduce or change it?

Although you have not mentioned the State where the society is located, I am presuming that the relecant State Act  provides for a tenure of 5 years. The said tenure can be cut short in two ways by either the Managing Committee itself resigning or  a No confidence motion being brought against it in a GB meeting.

As regards the Bye-Laws, they have to be approved by the Registrar and any reduction in the tenure can be brought about by amending the Byer-Laws again in a GB meeting and then gettiong the changes approved by the Registrar.

I hope this will serve your purpose.

     Regards
