Our society is in the process of redevelopment.In our society ownership of 2 nominee members are in dispute. Society has accepted the nominee as provisional member as per amendment of transfer of flat after death of member.Is he entitled to rent by developer after vacating the flat. What will be society's stand. At present nominee is staying in the flat and paying the maintenance.

The nominee shall hand over the flat to the legal heirs of the deceased owner.

In one case nominee is also legal heir but the other legal heir has filed a case against him. In the other case as per the death will nominee has claimed but he is not legal heir.In all the absolute ownership is not yet defined.and the dispute is going on and hence society has accepted nominee as provisional member as per law.
