Stamp duty for civil suit

Dear Experts,

 

My late mother gave all her property to her grandson (my elder brother son).

I want to file a suit asking for  cancellation of the sale deed. The registered sale deed value is Rs 1800000 (18 lakhs). My question is

 

1) How much could be approximate court fees I have to pay for filing this civil case.

2) If I loose the case - will i loose the court fees ?

3) If I win the case - will I get court stamp fees refund? 

I need only minimum approx charges idea.

1) Which state you are from ?

2) Which year deed was registered ?

3) When you found out about deed ?

4) Your question comes under your state Court fee act? The valuation will be for 18 Lakhs. But if cost of property is high and other party objects and prove it your have to pay more court fee

5) If you loose case you will loose court fee + you have to pay cost (This is situation in maharashtra)

6) Yes you can get court fee and cost if you win , but for that decree execution application you have to do .
