Project cancelled by builder

I had booked a serviced studio apartment (in September 2009) with ARN infrastructure at Greater Noida.

The builder was supposed to hand over possession by sep 2011.

In 2012 the builder announced the project "CANCELLED".

Now all he is agreeing to is to refund the paid amount with 12% interest.

 

Part of the land has been transferred to another builder and is being developed and sold.

I do not want to take the refund. Can I insist that I only want an apartment at that site. After cancelling this project, flats will be built on the same site in name of some other project.

Can I expect to get an apartment in that case.

The case is already registered in consumer forum and my complaint has been received by the builder. Now he is supposed to give his reply in the next hearing.

Please suggest what demand can I stick to.

You have to stick up the prayer what you have made in the consumer complaint
