perjury can be filed under section 340 crpc along with section 193 ipc which deals with punishment of false affidavit and maintenance case u can take evenplea that other party not come with clean hands and trying the court to mislead and hence not eligible for any benefit from court

hello,
u need to file an application praying the same.
court will initiate proceedings if found that there is gross miscarriage of justice.
there are many case laws on the same.
