Notice from landlord

Dear Seniors.

We have received the notice from landlord to evacuate the shop in mumbai suburbs. The case details are as follows.

The shop is under paghdi system and is occupied from 1960 onwards. We have been paying the rent regularly and we have the receipts. The shop is in the name of my grandpa and still its the same.

The reason for vacate is mentioned that rent is insufficient to pay the tax. The date is given 14th april 2013 for vacate. The landlord recently sold his right to builder and is informally telling us to vacate the shop as that arae will go under road cutting.

We mentioned this to one of the lawyer and he told us that if shop goes in road cutting, builder will get extra FSI so you will always get your right.

Please advise that what should be the our first step to tackle this and there are three more shop in similar condition owned by others.

 

Secondly how should we make our case stronger so that landlord does not harass us.

Also any practicing lawyer can help us professionally

file a suit for bare injunction agianst your previous landlord and the builder, not to disposses you wihtout due process of law, the builder can only disposses you after filing a suit and  obtaining a decree against you for vacating the schedule premises, and u can contest the suit with the help of a local lawyer.

Dear Sir,

We have received the notice from current landlord and not from the builder.

The builder story I mentioned because, that is the reason why landlord is doing all this.

the notice might have been issued under 106 of the transfer of property act or under local state laws. contest the case
