Nh compenseation

Sir, I am confused, If I am on duty in any National Holiday you says company was pay double wage for such day. Double wage means one normal wage + Two extra wages = 3 days wage or total 2 days wage. Sir I want to say that if I will enjoy the national holiday company must be pay  that days salary, whether I will do duty on such day company  pay me extra one day wage. Is it the proper compensation for the National Holiday ?  In SAIL company will pays only 2 days wage for National Holiday. Is it correct procedure as per rule. For Ex if any NH comes in my weekly holiday company provide me such days normal wage in addition of one extra off day which is taken within six month, in this case I was get benefit of NH, but when I am on duty on such day I was get the same benefit, then which way company pay extra wage of NH to me in this case. If any judgement about this case or any guideline for this please provide me thank you.

Go thru:

National & Holidays Act

Weekly Holidays Act

Factory Act (If it is a factory)

Shops and Commercial Establishments Act (If it is a Shops or Commercial Establishments)

Standing Orders, Leave policy of your company………………………….and clauses on Wages for holidays.

 

Daily wages: Monthly Wages/26

Double Wages; Monthly Wages/26*2

Sir as per National Holiday act, If any one can do duty on such day he/she is eligible to get twice the wage or one day wage in addition to one substitute off . But in our case we get only one day extra wage or one extra off day. In totality of monthly wage we get 30 days normal wage with addition of optional (one day wage or one day off). If it is correct as per rule then please aware me whether there is any rule for which the company will force me to do a compulsory duty on National Holiday. If not then kindly let me know the rules as per ID Act, that how we avoid such a compulsory duty which would forcefully given us by the company .

You may go thru the enactment as enacted in your state e.g;

 

THE KARNATAKA INDUSTRIAL ESTABLISHMENTS (NATIONAL

AND FESTIVAL HOLIDAYS) ACT, 1963:

Section: 3, 3A, 4, 5, 7, 8, 9A, 10………………….

 

And approach Inspector.
