Sir/Madam,
I would like to know the Authorities(preferably of Bombay High Court) on Limitation Act Art 74. I have a problem to discuss that the accused is aquitted in appeal. Thereafter, Complainant filed an appeal in the Hon'ble High Court. The said appeal is admitted. Meanwhile, the Accused brought civil suit under Malicious Prosecution as well as criminal case for defamation. Now the question arises weather the civil suit is tainable as the merit of Appeal in High Court is yet to be decided. What is the correct interpretation of Art 74 of Limitation Act.
