Illegal action by the Tehsildar..

Page no : 2

The query does not seem to have any substance, as there are many holes in the story.

The point of Mr. Jigyasu, as in his response addressed to the author of the problem, needs to be taken well when the querist has not stated that the problem relates to him only.

As such, I may like to differ with the advice of Advocate, Shri Vijay Raj Mahajan, In revenue related matters, interference by any revenue autrhority in the absence of any injunction cannot be assumed as the contempt of court?

Further, without any notice board about dispute, there is no relevance to assume that land is disputed one. Even if the land is disputed one and the case is in the revenue court, until any injunction is issued any action by the revenue authorities, as deemed fit, cannot be barred.

In the instant case, 1st of all, the author of the querist has not stated that the problem relates to him in person.

2ndly, he has not stated anywhere that any injunction was taken from the competent court.

3rdly, he has not mentioned anywhere that a notice board was placed on the land about any dispute.

4thly, he has not stated anywhere that the land owner submitted any objection before the Tehsildar and further what was his reaction to that.

He has simply desired to know, as if the Tehsildar had a power to decide the stated matter, as if he wanted to find answer to his academic query.

SO FROM ALL ANGLES, THE QUERY IS QUITE VAGUE IN NATURE.
