If husaband doesn't come after 6 months in mcd

Hi

we both filed Mutual consent divorce but after 6 months he is not appearing in court. How can i get divorce now?

both the parties must attend on hearing dates. then only court will consider to issue mutual divorce order.

You both the parties should have to be physically present before the court on the hearing date of your second motion otherwise court will issue you another date , both of you have to finish your mcd within a limitation of 6-18 months , otherwise your MCD petition will be dismissed by the court .

If either of the party is not attending the court on the second motion i.e.,after 6 months of first motion, and if there is no representation by the counsel seeking an adjournment with valid reasons, the court may dismiss the MCD case, the aggrieved party has to re-approach the court for divorce on some other grounds only based on the facts with a new case..
