Domestic violence case - andhra pradesh

There is an allegation in the petition that the parents of the petitioner (bride) have given 
a)dowry to the respondent (husband)
b)gold jewellery to the respondent (husband)
c)paid marriage expenses

The husband's family denies the allegation and have filed a counter for the proofs.

Advice prayed from the experts:

Giving dowry is being a cognisable offence ,can the respondent directly approach the court for the orders where the trial is on-going for police investigation
or
Should the respondent first approach police for investigation based on the petition and in case they reject to FIR, only then he can file with magistrate under CrPC 156 (3).
