A plaintiff/petitioner filed a simple Injunction suit against his co sharer that injunction be granted till partition done by metes and bounds, the respondent filed a counter claim for mandatory injunction from stopping plaintiff to stop him from raising construction from a particular piece of suit land and also filed a application under order 1 Rule 10 for addition of respondent in counter claim to add petitioner son who is till no where recorded in revenue/property records.
My question is :
1. Can respondent raise such kind of counter claim which is totally against the relief claimed in the main suit.
2.Can counter claim be filed against more parties which are not in main suit. i mean are not petitioner.
