Maintainence claim/salary proof/deductibles

Wife has filed false 498A/406 cases against husband and his family. She has now claimed maintainence for self (tho she is employed and earning well) and child and has made exhorbitant claims  about husband's salary. Kindly advise what proofs/documents husband has to submit to evidence his salary? What all documents do the Courts ask for? Do the courts look at gross salary or net take home basis (after deducting tax, insurance, provident fund etc).

You provide your income details, ie what is left after all exp, insurance, loans, EMIs etc. ie actual income minus expenditure. Try to show her income also that she is earning.

Thanks. Petitioner has asked that husband should submit copies of IT returns. Is it mandatory to do so? Can we ask court to direct petitioner to also submit her IT returns to prove her income?

you can show the paid insurance amounts, medical expenses for you parents if any, children school fees, rent amount if any, expenses are to be shown monthly on month basis what all you pay

you can also ask her income proof through your lawyer

Its not mandatory as such. You can avoid submitting such details, but if you do so, be ready to pay whatever your lovely has asked for be it 10k per month or 1 lac pe month.  Burden of proof lies on you be it for showing your income or proving that your lovely is working.
