Contract Labor PF

Hi there,

I want to know who is responsible to pay PF behalf of contract worker,whether Principal employer or the contractor?

The Contrator is liable to pay PF contribution. However, the principal employer to ensure not only that the minimum wages are paid to the contract labour engaged in connection with their work/service but also ensure that any statutory payments including PF are deducted/remitted by the contractor. If the Contracor has PF registration, the principal employer to check the proof of remittance of PF in due course by the contractor and if he has no registration, the principal employer has to collect the contribution from the contractor and remit the same from its account, with the PF authorities.

If the contract labour is hired only for two days to remove the grass inside the factory premises should there be deduction for P.F. ? If yes what benefit the contraact labourer will get for two days P.F contribution paid by him?

Principal Employer is ultimately responsible for all statutory obligation including PF, ESI,bonus etc.  If contractor is not fulfilling any statutory obligation then concerned govt. dept will taken action against the principal employer and not against the contractor.

Principal employer must ensure that contarctor is paying PF, ESIC etc (as agreed in the contarct agreement).
