Sir I and my brother are owner of undivided one half share in the suit property. My elder brother has executed the sale for entire property and vandee is in possession of entire property. Before this purchase the vandee was a tenant for more than two decades. Now i have filed the suit for declaration , partition possession permanant injunction in the civil court. Here declaration is my substantial releif and rest are the consequential releif. Accoedingly i have levied the court fee on the value of sale deed document. My question is whether the partition can be claimed as a consequential releif. plz mention any judgement if u know Thanx
