Sir,
I made a payment to buy a property at my place.
The flat was yet to regularize under BRS.
I have paid more than 35% of the actual flat value.
Now the builder is demanding for the balance payment.
Is it legal for him to demand the payment?
Also he wrote an agreement for the payment in which he mentioned that the balance must be paid with in 3months from the agreement date. The said date was also lapsed 2 months ago.
Now he is not only demanding us for the payment but saying that the agreement is expired as we have mentioned the period for 3 months. And he is demanding interest on the remaining amount.
The clauses expiry and interest were not specified in the agreement.
Kindly suggest.
