Accident case

I met with acccident in 2001 with auto where had body fracture and MVC case at kahmmam court where in it got dismissed with reasons of 

1] 4 months delay in filing fir and

2] Police had not sent the insured vehicle to the inspection

Can you please share with me any judgments for the same for the insurance claim alow for above 2 cases?
